These terms and conditions govern your use of our website. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.
  1. WEBSITE ACCESS - It is not necessary to register with us in order to use most parts of this website. 
  2. USE OF WEBSITE - This website may be used for your own private purposes and in accordance with these terms and conditions.
  3. DOWNLOADING FROM WEBSITE - You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.
  4. PRICE VARIATION - Estimates are based on Menu Printers current costs of production and unless otherwise agreed are subject to amendment on or at any time after acceptance to meet any rise or fall in such costs.
  5. TAX - Menu Printers reserves the right to charge the amount of any taxes, value added tax, duties or royalties, etc - which are payable whether or not included on the estimate, sales order or invoice
  6. DEPOSITS - All deposits are non-refundable
  7. PRELIMINARY WORK - All work carried out, whether experimentally or otherwise at the customer's request shall be charged. Should a layout not be specified when placing an order and the customer wishes to change the layout provided by Menu Printers reserves the right to charge an additional charge for the extra typesetting work completed.
  8. COPY - A charge may be made to cover any additional work involved where copy submitted is not clear and legible
  9. PROOFS - Proofs of all work will be submitted for customer's approval and Menu Printers shall incur no liability for any errors not corrected by the customer in proofs so submitted and signed and agreed ready to print.
  10. ADDITIONAL ALTERATIONS - Menu Printers reserves the right to charge for additional customers alterations that were not made clear at the time of supplying the original copy.
  11. PRINTING MATERIAL - The normal paper that is used for Menu Printers menus is 130gsm glossy paper, if you require other paper Paper the person ordering should request a price for different paper for their menu to be printed on, a sample of the paper will be supplied prior to printing. Should the customer not do so then they will accept the paper the menu is printed on.
  12. COLOUR MATCHES - Customers who require colour reproduction of a specific colour and who wish to check the colour reproduction prior to printing must order a colour proof, by email/in writing, prior to printing. This will be charged as an extra, it is the customers own responsibility to ensure that the colour photograph(s), transparency(ies), graphics or cliparts submitted by themselves are suitable for the work in hand. Menu Printers cannot accept liability for unsatisfactory results caused by unsuitable or inferior cliparts or photographic originals.
  13. FULL COLOUR PRINTING - Every effort will be made to obtain the best possible colour reproduction on customers work. Due to the nature of the processes involved Menu Printers shall not be required to guarantee an exact match in colour or texture between the customer's original colour photograph or transparency and the printed article.
  14. LOSS OR DAMAGE - Whilst ever care is taken Menu Printers and its agents cannot accept any responsibility for loss or damage to artwork, photographs, transparencies etc. Any liability shall be limited to the replacement cost of the basic materials.
  15. SUSPENDED WORK - Should work be suspended at the request of or delayed through any default of the customer, for a period of 15 days or more Menu Printers shall then be entitled to payment for work already carried out, materials especially ordered and any other additional costs incurred including storage.
  16. COMPANY IMPRINT - Menu Printers reserves the right to include its imprint on any work carried out by them
  17. DELIVERY - Delivery of work shall be accepted when tendered. Delivery is accepted as to mean to one address only. If delivery is to more than one address then Menu Printers reserves the right to charge an additional delivery fee, which must be paid before the additional delivery will be made. No delivery date is guaranteed unless it is confirmed in writing by Menu Printers prior to confirmation of acceptance of the customer's order. Should express delivery be agreed extra may be charged to cover any overtime or any other additional costs involved.
  18. COMPLETION DATES - No completion dates are guaranteed unless 'Express Service' is specified and paid for and the required date notified in writing. In event of such a completion date not being met then Menu Printers liability shall only extend to the refund of the 'Express Service' charge.
  19. STORAGE CHARGE - Menu Printers shall be entitled to make a reasonable charge for the storage of any customer's property left with Menu Printers before receipt of the order or after notification to the customer of completion of work
  20. OWNERSHIP - Ownership of the work shall not pass to the customer until payment is received in full by Menu Printers.
  21. PREPAYMENT - Menu Printers reserves the right to insist upon payment being received prior to commencement of work. Full payment is due on notification that the artwork is ready for printing.
  22. ACCOUNT FACILITIES - Menu Printers does not offer account facilities.
  23. OVERDUE ACCOUNTS - Sums unpaid after the due date shall bear interest from the date of delivery or invoice whatever is the earlier at 2% per month accruing day by day. This is additional to any interest that may be claimable under Section 69 of the County Courts Act as defined at the appropriate time. OVERDUE LETTERS - A sum of £25 per letter will be payable for any debt collection letters that have to be sent regarding over due accounts.
  24. VARIATIONS IN QUANTITY - Every endeavour will be made to deliver the correct quantity ordered. Estimates are conditional upon margins of 5% for work supplied.
  25. DISPUTES - In any dispute concerning materials or colours used in the production of the printing order Menu Printers decision is final
  26. CLAIMS - Any queries regarding the invoice or the goods supplied must be made to Menu Printers in writing within 7 days of invoice date or delivery date whichever is the latest. Any query regarding non-delivery must be made within 14 days of the invoice date. Claims outside this limit will not be entertained. Menu Printers shall not be liable in respect of any claims unless the aforementioned requirements have been complied with.
  27. LIABILITY - Menu Printers shall not be liable for any loss to the Customer arising from delay in transit.
  28. PRODUCTION MATERIAL - any materials used by Menu Printers to produce menus for customers remained owned by Menu Printers and the customer has no rights over these materials.
  29. PDF’s - PDF’s prepared by Menu Printers will only be supplied in Low Resolution. The customer can’t use the pdf’s for any purpose whatsoever without the written permission of Menu Printers. Should the customer use the PDF’s for another use they will be infringing the copyright of Menu Printers.
  30. CUSTOMERS PROPERTY - except in the case of a customer who is not contracting in the course of a business nor holding himself out as doing so, customer's property and all property supplied by Menu Printers on behalf of the customer shall, while it is in the possession of Menu Printers or in transit to or from the customer, be deemed to be at the customer's risk unless otherwise agreed and the customer should insure accordingly.
  31. LIABILITY - If the customer is trading as a Limited Company and does not pay for the order(s) in question then the person signing the order for the printing shall become personally liable for the debt and shall be bound by all the terms and conditions shown hereon.
  32. INSOLVENCY - If the customer ceases to pay his debt in the ordinary course of business or cannot pay his debts as they become due or being a company is deemed to be unable to pay its debts or has a winding up petition issued against him Menu Printers without prejudice to other remedies shall (i) have the right not to proceed further with the contract or other work for the customer (ii) be entitled to charge for work already carried out (whether complete or not) and materials purchased for the customer, such charge to be an immediate debt to him, and (iii) in respect of all unpaid debts from the customer have a general lien on all goods and property in his possession (whether worked on or not) and shall be entitled on the expiration of 14 days notice to dispose of such goods or property in such a manner and at such a price as he thinks fit and to apply the proceeds towards such debts
  33. ILLEGAL MATTER - Menu Printers shall not be required to print any matter that in it's opinion is or may be of illegal or libellous nature or an infringement of the proprietary of rights of any third party
  34. COPYRIGHT & INDEMNITY - The customer shall be responsible for obtaining all necessary authority to reproduce pictures, artwork, photographs, maps etc. Menu Printers shall be indemnified by the customer in respect of any claims, costs and expenses arising out of any libellous matter or any infringement of copyright, patent, design or any other proprietary or personal rights contained in any material printed for the customer. The indemnity shall extend to any amounts paid on a lawyers advice in settlement of any claim
  35. FORCE MAJEURE - Menu Printers shall be under no liability if it shall be unable to carry out any provision of the contract for any reason beyond its control including (without limiting the foregoing) Act of God, Legislation, War, Fire, Flood, Drought, Failure of Power Supply, Lock Out, Strike or other work action taken by employees in contemplation of a furtherance of a dispute or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency the customer may by written notice to Menu Printers elect to terminate the contract and pay for work done and materials used, but subject thereto shall otherwise accept delivery when available.
  36. LEGAL COSTS - Should Menu Printers have occasion to commence legal action by reason of the customer's default in paying, the customer shall pay any and all solicitors and ancillary administrative costs incurred by Menu Printers on a full indemnity basis
  37. LAW - These conditions and all other express terms of the contract shall be governed and construed in according with the laws of England.
  38. PREVALENCE OF THESE CONDITIONS - These conditions shall prevail over the buyer's standard terms and conditions in all cases and circumstances whatever (unless otherwise provided herein) and no term in the buyer's standard terms and conditions shall have any force or effect whatsoever.
  39. CONTRACTURAL CONDITIONS - All work accepted by Menu Printers is strictly on a contracted basis and establishes the acceptance of all the aforementioned terms and conditions
